Terms of Service

These Terms of Service ("Terms") govern your use of CVAI (the "Service"), operated by CVAI ("we", "us", "our"), accessible at cvai.nz. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

CVAI uses artificial intelligence to help you tailor your CV and cover letter to specific job listings, score how well your CV matches a role, and search job listings on third-party sites. The Service is provided to individuals for personal job-seeking use.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service you confirm that the information you provide is accurate and that you have the right to use it (for example, your own CV and career history).

3. Accounts

You are responsible for maintaining the security of your account, including any login codes sent to your email. Notify us immediately if you suspect unauthorised access to your account. We may suspend or terminate accounts that we reasonably believe are being used fraudulently, abusively, or in breach of these Terms.

4. Credits and Payment

4.1 The Service operates on a prepaid credit system. You purchase credit via Stripe, and credit is deducted as you use chargeable features (CV generation, cover letter generation, match scoring, and job scanning). Current pricing for each action is displayed within the Service.

4.2 New accounts receive a limited number of free trial generations. After the trial is used, credit is required to continue.

4.3 Credit purchases are processed by Stripe. We do not store your card details.

4.4 Credit is non-refundable, except where required by the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 (for example, if the Service fails to perform as described due to a fault on our part). If you believe you are entitled to a refund, contact us at hello@cvai.nz.

4.5 Unused credit does not expire but is forfeited if your account is terminated for breach of these Terms.

4.6 You may enable automatic top-up, which will charge your saved payment method when your balance falls below a threshold you select. You can disable automatic top-up at any time from your account settings.

4.7 We may change our pricing at any time. Changes will not affect credit you have already purchased.

5. Referral Program

5.1 We may offer credit bonuses for referring new users, subject to conditions displayed within the Service (currently: the referred user must complete a qualifying top-up).

5.2 We reserve the right to withhold or reverse referral bonuses obtained through fraudulent activity, self-referral, fake accounts, or any attempt to manipulate the program.

6. AI-Generated Content

6.1 CVs, cover letters, match scores, and job rankings produced by the Service are generated using artificial intelligence based on information you provide and publicly available job listing data.

6.2 You are solely responsible for reviewing all AI-generated content before use. The Service may produce content that is inaccurate, incomplete, or does not perfectly reflect your actual skills or experience. Always check generated content for accuracy before submitting it to an employer.

6.3 We do not guarantee that using the Service will result in interviews, job offers, or any particular employment outcome.

6.4 You must not knowingly submit AI-generated content containing false claims about your qualifications, experience, or right to work.

7. Acceptable Use

You agree not to:

• use the Service to scrape, harvest, or extract data at a scale beyond normal personal use;
• attempt to circumvent rate limits, credit charges, or trial restrictions;
• create multiple accounts to obtain additional free trials or referral bonuses;
• use the Service for any unlawful purpose or to generate misleading or fraudulent application materials;
• attempt to gain unauthorised access to the Service, other users' accounts, or our systems;
• resell or provide commercial access to the Service without our written permission;
• use the Service to harass, defraud, or impersonate any person.

We may suspend or terminate your account for breach of this section.

8. Third-Party Job Listings

The Service may retrieve and display information from third-party job listing websites (such as SEEK) to help you find and assess roles. We are not affiliated with these websites, do not control the accuracy of their listings, and are not responsible for their content, availability, or terms of use. Your use of any third-party site remains subject to that site's own terms.

9. Intellectual Property

9.1 You retain ownership of the CV content, career history, and personal information you upload.

9.2 We retain ownership of the Service itself, including its software, design, and underlying technology.

9.3 You grant us a limited licence to process your uploaded content solely for the purpose of providing the Service to you (for example, generating a tailored CV).

10. Disclaimers and Limitation of Liability

10.1 The Service is provided "as is" and "as available". To the maximum extent permitted by law, we exclude all warranties not expressly stated in these Terms.

10.2 Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be excluded.

10.3 To the maximum extent permitted by law, our total liability to you arising out of or in connection with the Service is limited to the amount you paid us in the three (3) months before the event giving rise to the claim.

10.4 We are not liable for any indirect, consequential, or special loss, including loss of employment opportunity, loss of income, or reputational harm arising from your use of AI-generated content.

10.5 We do not guarantee uninterrupted or error-free operation of the Service. We may experience downtime due to maintenance, third-party service outages (including our AI provider, email provider, or payment processor), or events outside our control.

11. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, which forms part of these Terms.

12. Changes to the Service or Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may update these Terms from time to time; continued use of the Service after changes take effect constitutes acceptance of the updated Terms. Material changes will be notified via email or an in-app notice where practicable.

13. Termination

You may stop using the Service and close your account at any time by contacting us. We may suspend or terminate your access if you breach these Terms, engage in fraudulent or abusive conduct, or if we discontinue the Service.

14. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms or your use of the Service are subject to the exclusive jurisdiction of the courts of New Zealand.
